INDUSTRIAL PLANT LAW
Industrial Plant Law in Austria
From food trucks to cement factories — any permanent facility used for commercial activities that could potentially impact neighbors or the environment requires an operating permit (Betriebsanlagengenehmigung) in Austria. Industrial facility law is at the heart of the 1994 Trade Regulation Act (Gewerbeordnung 1994) and governs the permitting, operation, and supervision of industrial plants to prevent hazards, nuisances, and environmental harm. Special rules apply to large industrial plants (IPPC installations) under the EU Industrial Emissions Directive.
What we do: The management of your operating permits is in the best possible hands with us. We provide advice during the preparation of project submissions and represent you in permitting procedures before the district administrative authorities and provincial administrative courts. We review existing permits and assist with necessary modifications or simplifications. We advise on the implementation and application of requirements for IPPC installations and ensure that no unnecessary “gold-plating” occurs.
