EUROPEAN COURT OF JUSTICE
The European Court of Justice in Luxembourg is the Court of Justice of the European Union. It is divided into two courts (Court of Justice and General Court) and ensures the uniform application of EU law in all member states through its interpretation of EU law. It is also responsible for deciding on legal disputes between national governments and the EU institutions.
What we do: Proceedings before the European Court of Justice are particularly challenging: as there is normally no possibility to refer a case directly to the European Court of Justice, a request for a preliminary ruling must be initiated in which an Austrian court refers questions on the interpretation of EU law provisions to the European Court of Justice. In this case, it is important to present the problem under EU law precisely and to pre-formulate the questions to be put to the European Court of Justice in such a way that the national court cannot avoid making a reference for a preliminary ruling. Oral proceedings before the European Court of Justice have their own peculiarities: Short speaking time, no repetition, meticulous objectivity, no advocatory blathering, transcripts for interpreters and, and, and ....
