Nature Conservation Law
Due to the case law of the European Court of Justice, the nature conservation instruments established at EU level for the protection of sites and species are increasingly prioritising the interests of nature conservation over all other interests. Economic interests are only taken into account at the downstream level of the exemption assessment and are subject to stringent requirements. In particular, the protection of species enshrined in the nature conservation laws of the federal states also affects projects outside areas that are particularly worthy of protection. The EU Restoration Regulation will also have an impact on authorisation projects.
What we do: We advise and represent clients in all matters of nature conservation law — including permitting procedures in grassland and Natura 2000 areas as well as applications for exemptions under species protection law.
