Public Service Law in Austria

Public service law comprises - as a collective term - many different laws (Civil Service Act, Contractual Employees Act, Salaries Act, Federal Equal Treatment Act, state-specific regulations) that regulate the employment relationship between a natural person and a regional authority. A distinction is made between "civil servants" and "contract staff". Civil servants are appointed by official notice; contract staff have an employment relationship under private law (similar to employment contracts concluded in the private sector). The qualification as a civil servant or as a contract employee is decisive for the rights and obligations of the employee as well as the legal protection available to him. While legal disputes involving civil servants are typically brought before the administrative courts, contract employees are granted legal protection before the civil courts.
